Theo quy định tại Điều 3 Quyết định 15/VBHN-BKHCN của Bộ Khoa học Công nghệ về việc ban hành “quy định về việc cấp, sử dụng và quản lý mã số mã vạch” theo đó “Mã vạch là một dãy các vạch thẫm song song và các khoảng trống xen kẽ để thể hiện mã số sao cho máy quét có thể đọc được.” Còn “Mã số là một dãy các chữ số dùng để phân định vật phẩm, địa điểm, tổ chức.”
Mã vạch có thể được đọc bởi các thiết bị quét quang học gọi là máy đọc mã vạch hay được quét từ hình ảnh bằng các phần mềm chuyên biệt. Mã vạch thể hiện các thông tin về sản phẩm như: Nước sản xuất, tên doanh nghiệp, lô, tiêu chuẩn chất lượng đăng ký, thông tin về kích thước sản phẩm, nơi kiểm tra…
- Cấu tạo của mã số doanh nghiệp
Mỗi sản phẩm chỉ mang một mã vạch duy nhất mà không bao giờ thay đổi. Đối với mã số: Cấu trúc của mã số thương phẩm toàn cầu loại thông dụng nhất hiện nay tại Việt Nam là mã GTIN 13 gồm 13 chữ số. Khi đọc mã số này chúng ta đọc từ trái sang phải theo thứ tự sau:
– Ba chữ số đầu tiên 893 thể hiện Mã quốc gia GS1 do Tổ chức GS1 quản trị và cấp cho Việt Nam;
– Bốn, năm, sáu hoặc bảy chữ số tiếp theo thể hiện Số phân định doanh nghiệp do GS1 Việt Nam quản trị và cấp cho tổ chức sử dụng mã số GS1;
– Năm hoặc bốn hoặc ba hoặc hai chữ số tiếp theo thể hiện Số phân định vật phẩm do tổ chức sử dụng mã số GS1 quản trị và cấp cho các vật phẩm của mình;
– Chữ số cuối cùng thể hiện Số kiểm tra (được tính từ mười hai chữ số đứng trước theo thuật toán xác định của GS1).
Bởi vậy để đảm bảo uy tín, thương hiệu cho doanh nghiệp, việc sử dụng mã số mã vạch là một biện pháp phân biệt sản phẩm, cũng như tạo lòng tin của người tiêu dùng
- Đăng ký mã số mã vạch
Việc cấp mã số mã vạch thực hiện theo trình tự sau đây:
– Đăng ký sử dụng mã số mã vạch;
– Tiếp nhận hồ sơ đăng ký sử dụng mã số mã vạch;
– Thẩm định hồ sơ và cấp Giấy chứng nhận quyền sử dụng mã số mã vạch;
– Hướng dẫn sử dụng mã số mã vạch.
a) Đăng ký sử dụng mã số mã vạch:
Các tổ chức/doanh nghiệp muốn sử dụng mã số mã vạch phải đăng ký sử dụng mã số mã vạch tại các cơ quan được Tổng cục TCĐLCL chỉ định tiếp nhận hồ sơ đăng ký sử dụng mã số mã vạch (sau đây gọi là Tổ chức tiếp nhận hồ sơ).
Hồ sơ đăng ký sử dụng mã số mã vạch gồm 01 bộ, cụ thể như sau:
– Bản đăng ký sử dụng mã số mã vạch theo mẫu quy định tại Phụ lục I của Quy định này (02 bản);
– Bản sao Giấy chứng nhận đăng kí kinh doanh đối với các doanh nghiệp sản xuất, kinh doanh, thương mại hoặc bản sao Quyết định thành lập đối với các tổ chức khác (Xuất trình bản chính để đối chiếu, trừ trường hợp bản sao đã được chứng thực) (01 bản);
– Bảng Đăng ký danh mục sản phẩm sử dụng mã GTIN theo mẫu quy định tại Phụ lục II của Quy định này (02 bản).
b) Tiếp nhận hồ sơ đăng ký sử dụng mã số mã vạch
Tổ chức tiếp nhận hồ sơ có trách nhiệm hướng dẫn các tổ chức/doanh nghiệp đăng ký lập hồ sơ đăng ký sử dụng mã số mã vạch tiếp nhận và xử lý sơ bộ hồ sơ đăng ký sử dụng mã số mã vạch
Trong thời hạn không quá 5 ngày làm việc, kể từ ngày nhận đủ hồ sơ, tổ chức tiếp nhận hồ sơ phải chuyển hồ sơ đến Tổng cục TCĐLCL.
c) Thẩm định hồ sơ và cấp Giấy chứng nhận quyền sử dụng mã số mã vạch
Trong thời hạn không quá 03 ngày làm việc, kể từ ngày nhận hồ sơ, Tổng cục TCĐLCL tiến hành thẩm định hồ sơ đăng kí sử dụng mã số mã vạch
Nếu hồ sơ hợp lệ, Tổng cục TCĐLCL cấp mã số; vào sổ đăng kí, lưu vào ngân hàng mã số quốc gia và cấp Giấy chứng nhận quyền sử dụng mã số mã vạch.
Nếu hồ sơ chưa hợp lệ, Tổng cục TCĐLCL đề nghị tổ chức/doanh nghiệp hoàn thiện.
Giấy chứng nhận quyền sử dụng mã số mã vạch được gửi cho tổ chức/doanh nghiệp sử dụng mã số mã vạch thông qua các tổ chức tiếp nhận hồ sơ trong thời hạn không quá 10 ngày, kể từ ngày được Tổng cục TCĐLCL cấp. Mẫu Giấy chứng nhận quyền sử dụng mã số mã vạch được quy định tại Phụ lục IV của Quy định này.
Khi tổ chức/doanh nghiệp sử dụng mã số mã vạch có sự thay đổi về tư cách pháp nhân, về tên gọi hoặc địa chỉ giao dịch hoặc Giấy chứng nhận bị mất hoặc hỏng, tổ chức/doanh nghiệp sử dụng mã số mã vạch phải thông báo bằng văn bản cho Tổng cục TCĐLCL để được đổi hoặc cấp lại Giấy chứng nhận mới.Tổ chức/doanh nghiệp sử dụng mã số mã vạch chịu trách nhiệm thanh toán các chi phí đổi và cấp lại Giấy chứng nhận quyền sử dụng mã số mã vạch.
